warranties, expressed or implied, of any kind with respect to products sold on
this website, including but not limited to, merchantability and fitness for a
particular purpose. By placing an order, you agree that the sole and exclusive
maximum liability to us arising from any product sold on this website shall be
the price of the product ordered. In no event shall we be liable for
special, indirect, consequential, or punitive damages related to product sold.
Except in respect
of death or personal injury caused by our negligence, under no circumstances
whatsoever shall we be liable to the buyer for any loss or damage whatsoever
(including but not limited to loss of profit or the loss of any other form of
financial or non-financial benefit; loss of use of or damage to any property;
work stoppage; any special, indirect, incidental or consequential loss or
damage; costs; expenses; and other claims for compensation), arising out of or
in connection with the sale of any of our products (including any
misrepresentation, unless fraudulent); any breach of an implied or express
warranty, condition or other term; (or any breach of a common law duty), in an
amount exceeding the price of the product giving rise to the claim, except as
expressly agreed in writing by us.
When placing an
order with Oz-Ebikes, either via online, e-mail, fax or phone, the purchaser
and user agrees to accept responsibility for all risks posed by our products
and to not hold Oz-Ebikes, the manufacturer, distributors or retailers -
(including all owners and employees) - responsible for any accident, injury or
death to persons or damage to property. All our products require skilled
installation and a good knowledge of bike mechanics, we test and assemble the
majority of our kit parts to ensure they arrive in perfect condition. If you
are unsure of how to install, adjust or service our products please contact us
or use your local bike shop mechanic.
Oz-Ebikes cares about
SAFETY and encourages all customers to exercise sound judgment in the building
and operation of all Electric vehicles. All customers should check the
laws with their local council or government body before operating an Electric vehicle
in a public place or on public land.
GENERAL
WARRANTY
All our products sold are warranted to be free
from manufacturer defects. Statutory 12 month warranty applies to most items
except for batteries. Please enquire at time of purchase if you wish to know more
about the warranty on a particular product.
Oz-Ebikes shall not be
held in any way liable to the buyer under this clause unless the conditions of
use and installation are complied with. This warranty will only be valid if
the following conditions are followed.
The product is installed
following the manufacturers recommendations.
The product is used
under normal operating conditions for which it was designed.
The product receives
proper maintenance if required.
The product has not been
subject to any modifications other than those approved of in writing by the
manufacturer or Oz-Ebikes.
The product has not been
used in conjunction with or installed with any unauthorized equipment.
Lithium polymer products
are to be charged using approved battery chargers and used in accordance with
supplied operating instructions.
All
Oz-Ebike products are guaranteed at the time of shipping to be in new condition
unless otherwise stated on invoice. The customer takes responsibility for the
product being insured at the time of shipping. Insurance is arranged at the
request of, and cost to the customer, OzEbikes is not responsible for loss or
damage of goods during shipping if no insurance has been requested and paid
for. Claims for items broken in transit shall be dealt with by the customer
unless insured, then we will handle any claim.
Oz-Ebikes checks both
the individual cell voltages and the battery pack voltage for every Lithium
battery pack before we send them out. Oz-Ebikes then warrantees all
packs to have proper assembly and cell voltage at time of purchase. In the
event that a customer finds defects in materials or assembly workmanship when
the goods are received but unused, Oz-Ebikes will replace such
packs within
RETURNS
Any products
returned to Oz-Ebikes for a warranty claim or return shall be at the cost of
the buyer. The customer must contact Oz-Ebikes to obtain a return authorization
before sending any products back otherwise we will accept no responsibility for
the returned items. Goods must be well packed, any damages occurring during
return are not the responsibility of Oz-Ebikes, the customer must ensure he/she
insures the item/s being returned. Goods being returned for credit/refund must
be in their original packaging and in as new unused condition, batteries must
be returned with all original packaging and paperwork for verification that
they have not been charged/used. It is at the discretion of Oz-Ebikes to accept
returns based on our inspection of returned goods. A restocking fee of 20%
applies to any goods that are returned for refund.
PLEASE NOTE: We have installed and
tested all our Electric kits, we know they work and we have many customers who
have installed the kit on their own, and with our email or phone help when
needed. Installation is not difficult with the right tools, but it is easy to
rush the installation, not test the setup carefully enough and then go out on
the bike and cause damage to the chain drive and associated components. If you
are in doubt about your installation DO NOT RIDE IT!! Email us with
photos, call up and explain your concerns, we are here to help you but we
cannot fix what you break from rushing the install or a lack of mechanical
knowledge/skill.
